Merkenrecht. Beroep tegen de weigering tot inschrijving van het woordmerk ,,FORTIFY” voor waren van klasse 9.
Het beroep wordt verworpen. Het woordmerk ‘FORTIFY’ is beschrijvend voor o.a. software voor het analyseren van broncodes. Het is beschrijvend omdat de term ‘fortify’ het beoogde doel van de waren omschrijft, namelijk het versterken van een computersysteem. De kamer van beroep heeft terecht niet gekeken naar het normaal gebruik van de waren.

In this connection, it should be observed that the distinction drawn by the applicant between fortifying a computer system through an alteration and protecting it from the outside has not been substantiated. As OHIM has observed, those two actions have the same intended purpose, namely to improve in some way the operation or performance of a computer system. The fact that the interventions take place from the inside or from the outside of a computer system does not alter the fact that the sign at issue will be perceived as descriptive by the relevant public, consisting of average consumers. Therefore, the sign FORTIFY directly describes the intended purpose of the goods in question.
