Normaal gebruik van "WALK IN THE PARK" voor kleding en schoeisel niet aangetoond

OHIM Cancellation Division, 31 juli 2013, The Backup Shoe v Hoogeboom.

Verzoekster The Backup Shoe vordert nietigheid van het Gemeenschapswoordmerk “WALK IN THE PARK” op grond van artikel 8(1)(a) en 8(1)(b) GMeV en beroept zich daarbij op haar oudere UK woordmerk ‘WALK IN THE PARK’. Het verzoek wordt afgewezen, nu The Backup Shoe niet erin is geslaagd normaal gebruik van haar oudere merk voor kleding en schoeisel in de periode van 8 juni 2007 tot 8 juni 2012 aan te tonen.

(34) Although some of the evidence indicates that the mark has been used as a trade mark tor some of the contested goods, it is not possible, based on the evidence submitted, to determine the extent of the use for any of the goods on which the application is based or if the use has been extensive enough to fulfill the criteria of genuine use for the contested goods within the relevant time period.

(35) The factors time, place, extent and nature of use are cumulative (see judgment of 05/10/2010, T-92/09, 'STRATEGI', paragraph 43). This means that the evidence must provide sufficient indications of all these factors in order to prove genuine use. Therefore, since the applicant failed to provide sufficient indications of the extent of use for any of the goods of the earlier mark, the Cancellation Division concludes, after an overall assessment, that the applicant has failed to provide sufficient indications of genuine use within the relevant time period.
