Gemeenschapsmerk – Vernietiging van beslissingen R 573/2013 1 en R-572/2013-4 van het BHIM houdende verwerping van de beroepen tegen de weigering van de onderzoeker om de woordmerken „INVESTING FOR A NEW WORLD” en „SO WHAT DO I DO WITH MY MONEY” in te schrijven voor waren en diensten van de klassen 35 en 36.

Beide beroepen worden verworpen. De woordmerken “INVESTING FOR A NEW WORLD” en “SO WHAT DO I DO WITH MY MONEY” missen elk onderscheidend vermogen. Het relevante publiek zal aan de hand van de merken de commerciële herkomst van de diensten (o.a. marktonderzoek) niet kunnen identificeren.

34 Furthermore, as the Board of Appeal stated in paragraph 33 of the contested decision, the word sign INVESTING FOR A NEW WORLD does not constitute a play on words and does not include any imaginative, surprising or unexpected elements capable of conferring distinctive character on it in the mind of the relevant public. Consequently, the sign at issue takes the form of an ordinary advertising message, which is devoid of any elements that might enable the relevant public to memorise it easily and immediately as a trade mark in respect of the services designated.

47 Consequently, in the contested decision, the mark applied for was not rejected on the sole ground that it would be perceived as promotional. The Board of Appeal did not reject the trade mark application on the ground that the sign constituted a promotional slogan, but on the ground that, beyond its promotional meaning, there was nothing in it which would enable the relevant public to perceive it as an indication of the commercial origin of the services at issue.
